Is a foreign power of attorney recognised by the land registry?
The land registry recognises a foreign power of attorney if it meets the formal requirements of Section 29 GBO and is accompanied by a certified translation that reproduces the scope of authorisation exactly. We translate the power of attorney so that the notary and land registry can clearly attribute the powers granted.
Must a precautionary or banking power of attorney be translated with certification?
As soon as a notary, a bank or the guardianship court uses the power of attorney as evidence, a certified translation by translators authorised or sworn in Germany is required for foreign-language documents. For purely internal use a simple professional translation is often sufficient – what matters is what the accepting body requires.
